Prosecutor issues annual Report
The Prosecutor of the International Criminal Court, Fatou Bensouda, issues her annual Report on Preliminary Examination Activities (2014).
Today, 2 December 2014, the Prosecutor of the International Criminal Court (“ICC”), Mrs. Fatou Bensouda, published her annual Report on Preliminary Examination Activities. The report provides an overview of her Office’s analysis and activities conducted between 1 November 2013 and 31 October 2014 in relation to eleven situations that were under consideration for possible investigation. Of these eleven situations, one proceeded to investigation (the Central African Republic), two were closed after the Prosecutor determined that the legal criteria for opening an investigation were not met (Republic of Korea; Registered Vessels of Comoros, Greece and Cambodia), and eight situations remain under on-going examination (Afghanistan, Colombia, Georgia, Guinea, Honduras, Iraq, Nigeria and Ukraine). Of these eight, two new preliminary examinations were opened during the reporting period in relation to the situation in Ukraine and the situation in Iraq.
The report provides a summary of the current status of each situation under preliminary examination, including the Office of the Prosecutor’s (“OTP” or “Office”) current analysis with regard to issues of jurisdiction and admissibility, as well as the activities carried out by the Office in 2014 in order to further this analysis. The report aims to help promote better public understanding and transparency regarding the Office’s preliminary examination process, which is the first step required to undertake prior to initiating an investigation.
The ICC Appeals Chamber confirms verdict

The Appeals Chamber of the International Criminal Court (ICC) delivered in open session on December 1, its judgments on Mr Lubanga’s appeal against the verdict issued by ICC Trial Chamber I, that Mr Lubanga was guilty of the enlistment, conscription and use in hostilities of children under the age of fifteen. The Appeals Chamber issued simultaneously its judgment on the appeals of the Prosecutor and Mr Lubanga against the sentence imposed by the Trial Chamber. The Appeals Chamber confirmed, by majority, the verdict declaring Mr Lubanga guilty and the decision sentencing him to 14 years of imprisonment.
During the open session, Judge Erkki Kourula, Presiding Judge in this appeal, read a summary of the Appeals Chamber judgments.
The Appeals Chamber rejected Mr Lubanga’s allegations that the proceedings were unfair and found that Mr Lubanga did not substantiate several grounds of appeal he raised. The Appeals Chamber established, with respect to factual errors, that it would not assess the evidence anew, but would intervene only if the Trial Chamber’s assessment of fact was found to be unreasonable. In applying this standard, the Appeals Chamber rejected, among others, the alleged errors in the Trial Chamber’s findings relevant to the age of the child soldiers.
With respect to the alleged legal errors regarding Mr Lubanga’s individual criminal responsibility, the Appeals Chamber confirmed the Trial Chamber’s approach that a co-perpetrator must make an essential contribution and does not need to personally and directly commit the crime.
With respect to the Prosecutor’s and Mr Lubanga’s appeals against the Sentencing Decision, the Appeals Chamber held that a Trial Chamber enjoys broad discretion in determining a sentence. The Appeals Chamber rejected all the grounds of appeal raised by the Prosecutor and Mr Lubanga, finding that the sentence was not disproportionate to the gravity of the crimes and reflected Mr Lubanga’s culpability for the crimes for which he was convicted. Accordingly, the Appeals Chamber confirmed the total sentence of 14 years.
Judge Sang-Hyun Song adopted a partly dissenting opinion in relation to the appeals against the verdict and the sentence. While agreeing with the majority’s decisions to reject the appeals, he disagreed with the Trial Chamber’s holding that the “enlistment”, “conscription” and “use to actively participate of in hostilities” of individuals under the age of fifteen are three separate crimes. Regarding sentencing, he found that the Trial Chamber should not have imposed three separate sentences for three crimes, but only one sentence for one crime.
Judge Anita Ušacka adopted a dissenting opinion with regard to Mr Lubanga’s appeal against the verdict. She respectfully disagreed with the decision of the majority of the Appeals Chamber to confirm the Conviction Decision, which she would have reversed on the grounds that (i) the charges of which Mr Lubanga was ultimately convicted were not sufficiently detailed, and (ii) it was not established beyond reasonable doubt that the children conscripted, enlisted or used in hostilities by the UPC/FPLC were under the age of fifteen. Accordingly, she also disagreed with the conclusions of the majority with respect to sentencing.

ICC Permanent Premises celebrates reaching its highest point
The International Criminal Court (ICC) Permanent Premises Project recently celebrated the important milestone of the highest point of the construction of the new building.
This achievement was celebrated during a ceremony at the construction site, attended by representatives of all the parties involved in the construction activities of the new ICC premises, including the ICC Project Team, Courtys’ construction and design teams, and all of the project subcontractors.
This ceremony, which marked the completion of the steel frame that is built around the Court Tower – the highest point of the structure, was marked by raising the construction team’s flag at that highest point. It was held in recognition of the enormous effort the construction team has put into ensuring the new premises remains on track, to be completed on schedule and within budget in the 3rd quarter of 2015.
In his speech, ICC Permanent Premises Director Neil Bradley stated that “this hugely important building will soon become the home of the ICC and for the next generation will be instantly recognised throughout the world as an important symbol of the quest for peace and justice”.
After just one and a half years of construction work, beginning in April 2013, the new ICC premises is now a major step closer to completion, with the façade complete and the remaining projects – landscaping and finishing the interior spaces – well under way.
Over 300 people who are currently working on the realisation of the ICC Permanent Premises attended the celebration, including engineers, architects, project managers and many of the specialist construction workers all of whom work collaboratively and simultaneously on different parts of the complex construction project.
International Day for the Elimination of Violence Against Women
Statement of the Prosecutor of the International Criminal Court, Fatou Bensouda, to mark the International Day for the Elimination of Violence Against Women
On this day, I add my voice to the countless and ever-growing voices of people around the world who say, ‘enough’ as we stand united in a global call to eliminate violence against women.
Our collective efforts can and must lead to tangible change to the archaic thinking and conduct that allow this scourge to persist. Humanity rightly demands the eradication of this blight. As Prosecutor of the International Criminal Court, I pledge my commitment to employ the full force of the law under the Rome Statute, to do my part.
We must end impunity for those who commit or allow crimes of violence against women to continue unabated, and by so doing, prevent future crimes. My Office is certainly committed to this task within the framework of the Rome Statute. We have set a strategic priority focus on combatting sexual and gender crimes, and how we concretise this strategic change has been crystallised into a policy paper, first unveiled last June and which I shall officially launch in a few weeks.
For the sake of those precious lives which have been affected; in the name of all the mothers and sisters, daughters and wives whose voices have been silenced; for the voices of courage, and the dignity of those who have suffered and endured violence; for all the future generations of women and girls who deserve protection from acts of violence, until we succeed, we will not give up.
Ambassador of Cuba presents his credentials to the King
Ambassador of Cuba presents his credentials to His Majesty Willem Alexander, King of the Netherlands.
The Hague, November 19, 2014 – In an official ceremony, the Cuban Ambassador Fermín Gabriel Quiñones Sánchez presented his credentials to His Majesty Willem Alexander, King of the Netherlands.
During the official talks that followed the formal ceremony, the new Representative of the Republic of Cuba to this Kingdom exchanged with the Dutch monarch and expressed his willingness to continue working on strengthening bilateral relations of different kinds, while His Majesty referred to the role of Cuba in the international arena and also called for the continuation of a respectful and mutually beneficial relation of cooperation for both countries.
New Ambassador of Guatemala in The Netherlands

His Excellency Mr Gabriel Edgardo Aguilera Peralta is since 19 November 2014 Ambassador of the Republic of Guatemala to the Kingdom of the Netherlands.

Ambassador Gabriel Aguilera is a sollicitor and notarius publicus with previous ambassadorial posts in Peru (non-resident to Bolivia; 2010-2014) and Germany (non-resident to Poland; 2008-2010). The new Head of Mission is fluent in English and German in additional to his native Spanish.
Ambassador Aguilera was educated in Guatemala but carried out his master studies in Freiburg, Germany. Thereafter he has completed several post-graduate degrees at institutions in Guatemala, Spain and the USA. He served as Deputy Minister of Foreign Affairs twice, between 1996 and 1999 and once more in the period 2003-2004.
Ambassador Aguilera presented last week his letters of credence to His Majesty King Willem-Alexander at Noordeinde Palace accompanied by his wife and the embassy staff.The new Guatemala’s Ambassador presented his letters of credence the same day as the new Cuban Ambassador Mr. Fermín Gabriel Quinoñes Sánchez and the Panamanian Ambassador Willys Delvalle Velasco. The following day, His Excellency offered a vin d’honeur at Carlton Ambassador.


Panamanian Ambassador presented his letters of credence to His Majesty

On 19 November 2014, Panamanian Ambassador Willys Delvalle Velasco presented his letters of credence to His Majesty King Willem-Alexander at Noordeinde Palace. He was accompanied by his wife, Tatiana, the embassy staff as well as the General Consul of Panama in Rotterdam, Mr Gustavo Leignadier.
The new Panamanian Head of Mission was followed by the new Cuban Ambassador Mr Fermín Gabriel Quinoñes Sánchez, and finally the Guatemalean Ambassador Mr Gabriel Edgardo Aguilera Peralta.
The Ministry of Foreign Affairs’ Secretary General drs. Renée Jones-Bos was also present as were some members of the Royal Household.
The Netherlands and Panama entertain diplomatic relations since 2 April 1904. During this long friendship, the two countries have signed agreements for the abrogation of tourist and business visa, to avoid double-taxation, for the protection of investments, aerial services, and for the operation of Dutch ships in the Panama Canal.
Ambassador Delvalle graduated from Florida State University, Business Faculty. Mr Delvalle is a specialist in Maritime and International Commercial Law. From 2006 and until 2012, he held the position of General Manager for APL (American President Line) in charge of the areas of operations, finance, sales, customer service and human resources for the company. Since 2012 until the present year, Mr Delvalle held the position of Senior Maritime Operations Manager for Latin America, with responsibilities for the entire region from Mexico to Chile.
From 2007 until 2014, was a member of the Board of Directors of the Panama Maritime. Chamber holding various positions in the Board, before being elected President of the Chamber from 2012 to 2014. During this time participated in various fora in the areas of logistics, bunkers, maritime operations and the Panama Canal.









One of the best Danish girls’ choirs performs in The Hague
The Danish Embassy to the Netherlands invites you to a Christmas Concert with the Danish Girls’ Choir of the church of Fredensborg Palace on Saturday, 6 December 2014, at 16:00 hrs. in Kloosterkerk, Lange Voorhout 4, The Hague.
The Girls’ Choir is part of an old tradition of the church of Fredensborg Palace. In 1850, King Christian the 9th opened the doors of the church of Fredensborg Palace to the public and since then, a choir has been connected to the church of Fredensborg Palace. Since 1985, the choir has been a girls’ choir.
Once a year, the Girls’ Choir is travelling abroad to perform for foreign public, this year in The Hague and Rotterdam. For many years the Girls’ Choir of Fredensborg Palace has been among the best girls’ choirs in the country which is demonstrated by top ranks in various competitions in Denmark. The Girls’ Choir performs at services and concerts in the church, a.o. in 2012 during the celebration of the anniversary of H.M. Queen Margrethe, but also at other occasions for royal guests. The Girls’ Choir is participating in all church services of the church of Fredensborg Palace. Princess Benedikte is protector of the choir.
The choir leader is Mr. Torsten Nielsen, singer and conductor from The Royal Danish Music Conservatorium. Mr. Nielsen is also connected to the Danish Broadcasting Corporation’s Vocal Ensemble and sings solo all over the country. Mrs. Else-Marie Kristoffersen accompanies the choir at organ. At this concert, Mrs. C. Buch is soprano soloist.
The concert is open to the public and is free of charge. Doors will be open from 15:30 hrs. The concert is presented in cooperation with APM Terminals.

With a reception at the Crowne Plaza Hotel, the Embassy of the Republic of Lebanon celebrated the country’s 71st Independence Day, many came to present their felicitations to charming Ms. Abir Ali, Chargé d’ affaires a.i and to join in the festivity.
The ancient country of Lebanon with its modern cosmopolitan capital city of Beirut is a true beacon in the region. Despite the current Syrian refugee crisis which is causing strain on the Lebanon’s political and socio-economic system, the country is looking to the future unfazed – a very resilient people indeed. The Lebanese people in a way resemble the pleasant scent- and robustness of the Cedarus Libani – cedar tree.
Lebanon and the Netherlands enjoy excellent relations and the Netherlands is supporting Lebanon to deal with the Syrian refugees crisis that put a lot of pressure on its political and socio-economic system due to the more than 1.3 million Syrian refugees that Lebanon is hosting.
“Lebannon is more than a country, it is a message of freedom and an example of pluralism”, words of H.H. Pope John Paul II in describing Lebanon. Last Tuesday was a day of celebration, and that is what has happened. Joyeuse fete nationale Lebanon!









Sultanate of Oman’s 44th Anniversary

On the occasion of the Sultanate of Oman’s 44th National Day Anniversary, the Ambassador of the Sultanate of Oman to the Kingdom of the Netherlands, His Excellency Muhammed bin Harub bin Abdullah Al Said, organized a diplomatic reception at the Crowne Plaza on Tuesday 18th of November. A special guest of honour to the event was Omani entrepreneur and owner of Oceanco and Chevron, Dr. Mohammed Ali Al Barwani, who presented the importance of business partnerships between Oman and the Netherlands. The hall of the reception was esthetically decorated with models of luxurious yachts, traditional clothing and progressive shell installations in Oman.


The Embassy of Oman in The Hague is also responsible (non-resident) for the Grand Duchy of Luxemburg.
His reception was also honoured by the presence of his mother, Her Highness Sayyida Shuruq bint Saif Al Said and her younger daughter Her Highness Sayyida Zahra bint Harub Al Said. Likewise by The Netherlands 49th Premier, Prof. Jan Balkenende.
The programme ended with the announcement of the two lucky winners of the Oman Air Raffle Ticket Prize. All guests left the reception delighted with a bag of traditional Omani sweets and selected souvenirs.
